1. OWNERSHIP OF THE WEBSITE

The owner of the website www.iloveferry.com, (hereinafter the WEBSITE), as well as iloveferry.es, iloveferries.com, and iloveferries.es, is I LOVE FERRY, a registered trademark of I LOVE VIAJES, (trading name of Javier Blanco Ibarreta), NIF 18.601.319T, a travel agency registered in the General Register of Tourist Companies, Establishments, and Professions of the Valencian Community with registration number CV m-1417-A, with its registered office at Santísimo Cristo del Mar, 35, 03730 Jávea (Alicante), and which makes this Website available to Internet users, in order to provide information on the prices, schedules, and offers of ferries operated by BALEÀRIA and FRED OLSEN in Spain, Morocco, and Algeria.

2. GENERAL TERMS OF USE AND ACCEPTANCE OF THEM

2.1. These General Terms of Use of the Website, together with the general contracting terms governing the provision of services, and/or any specific terms that may be established, are intended to regulate both the provision of information and the commercial relationships that arise between I LOVE FERRY and the users of the Website. By browsing the Website and/or using the services included on I LOVE FERRY, you acquire the status of USER. The browsing and/or use of any of the services of the Website imply the acceptance by the User, without reservation of any kind, of each and every one of these General Terms of Use, the General Contracting Terms that, where applicable, govern the provision of the services offered on the Website, as well as, where applicable, the Specific Terms that may exist in relation to the provision of the services.

2.2. I LOVE FERRY may at any time and without prior notice modify these General Terms, as well as the General Contracting Terms set out in the following Title III, and/or the specific terms that, where applicable, may be included, by publishing such modifications on the Website so that they may be known by the Users, always before visiting the Website or acquiring any goods offered on the Website. The modification will not be effective until three calendar days after its publication.

2.3. I LOVE FERRY assumes no responsibility for any discrepancies that may exist between the printed documents and the electronic version published on this website. In case of discrepancy between the printed version and the version published on the website, the printed version will prevail.

Title II «General terms of use of the website»

These General Terms will apply both to promotional activities and the provision of information carried out through the Website, as well as to the provision of the services offered on the Website, so that they will govern at all times, both for simple browsing of the Website, and for the acquisition of goods and/or the provision of services within the framework of the Website, although the latter activities will additionally be subject to both these General Terms of Use, as well as the applicable General Contracting Terms, and any specific terms that may exist.

1. PERSONAL DATA PROTECTION POLICY

1.1. In accordance with Article 13 of Regulation (EU) 2016/679, of 27 April 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data, you are informed that your data will be processed by I LOVE FERRY, a registered trademark of I LOVE VIAJES, as the data controller. The purpose of the processing is the management of the booking for the requested trip. This processing is legitimised by the execution of a transport contract. The data collected may be transferred to Public Administrations and State Security Forces, always in a justified and limited manner to the previously defined purpose, within the provision of agreed products or services. The data collected will be retained as long as there is a mutual interest, as well as for as long as they are necessary to comply with current legislation.

If the requested data is not provided, I LOVE FERRY will not be able to manage the trip you are requesting. You may exercise your rights of access, rectification, deletion, limitation, or opposition, as well as the right to data portability, by writing to I LOVE FERRY at the email address info@iloveferry.com. If you consider that the processing does not comply with current regulations, you may file a complaint with the supervisory authority at www.agpd.es.

1.2. The User expressly accepts the inclusion of the data collected during browsing of the Website, or provided through any form, as well as those derived from the commercial relationship, in the automated personal data file referred to in the first section. During the data collection process, and in each place on the Website where such data is requested, the User will be informed, either by means of a hyperlink or by including appropriate notices in the form itself, of the mandatory or voluntary nature of providing such data, except in the case of reservations, in which case I LOVE FERRY informs the User from now on that it will not be considered voluntary, as it will be necessary to provide identity, address, and credit card number data in order to make the payment, as these data are necessary for the formalisation and provision of the various services offered on the Website.

1.3. The User may exercise, in relation to the data collected in the manner provided in the previous section, the rights recognised in Organic Law 15/1999, and in particular the rights of access, rectification or cancellation of data and opposition, as appropriate, as well as the right to revoke consent for the transfer of their data or for any of the uses mentioned above. The rights referred to in the preceding paragraph may be exercised by each User by means of a written and signed request addressed to the following address: I LOVE FERRY, Stmo. 1.4. I LOVE FERRY informs that, for the user to access some parts of the content or services offered on the Website, it may be necessary to fill in registration forms, or similar, in which the user is asked to enter personal data. It is also possible that I LOVE FERRY, with the aim of improving its services, may activate "cookies" programs through which user data is obtained.

Cookies are small amounts of information stored in the browser used by each user so that the server remembers certain information that only the server that implemented it will subsequently read. Cookies generally have a limited duration.

No cookie allows contact with the user’s phone number, email address, or any other means of contact. No cookie can extract information from the user's hard drive or steal personal information.

The only way for a user's private information to become part of a cookie file is for the user to personally provide that information to the server. Users who do not wish to receive cookies or want to be informed of their setting can configure their browser accordingly.

1.5. By accepting these terms, the User expressly consents to the transfer or communication of the data included in the aforementioned file to I LOVE FERRY so that it may process their personal data to send them offers and advertising messages by any system, regarding its products and services. The User is informed that this transfer will take place at the time of collection of personal data.

The User has, in relation to the personal data provided, the rights of access, opposition, rectification, and cancellation, which they may exercise before the owner of the file or any of the assignees at the following address: I LOVE FERRY, Stmo. Cristo del Mar, 35 · 03730 · Jávea (Alicante) in the manner provided in section 1.3 above.

1.6. I LOVE FERRY is committed to using the data included in the file, respecting its confidentiality and using it in accordance with the purpose of the file, as well as to complying with its obligation to store it and to adopt all measures to prevent alteration, loss, unauthorised processing or access, in accordance with the provisions of the Security Measures Regulations for automated files containing personal data, approved by Royal Decree 994/1999, of 11 July.

2. INTELLECTUAL AND INDUSTRIAL PROPERTY

2.1. All the content displayed on the Website, especially designs, texts, graphics, logos, icons, buttons, software, trade names, trademarks, drawings, or any other signs that may be subject to industrial and commercial use are subject to intellectual and industrial property rights of I LOVE FERRY or third-party owners who have duly authorised their inclusion on the Website.

2.2. In no case shall it be understood that any license is granted or any waiver, transfer, total or partial assignment of such rights is made, nor is any right or expectation of right conferred, and in particular, of alteration, exploitation, reproduction, distribution, or public communication of such content without the prior express authorisation of I LOVE FERRY or the corresponding owners.

3. I LOVE FERRY’S LIABILITY

3.1. I LOVE FERRY will only be liable for damages that the User may suffer as a result of the use of the Website when such damages are attributable to a wilful act by this company.

The User acknowledges and accepts that the use of the Website, as well as the provision of services offered therein, is carried out at their own risk and responsibility.

3.2. I LOVE FERRY is not responsible for damages that may arise from, including but not limited to:

(i)                 Interferences, omissions, interruptions, computer viruses, malfunctions and/or disconnections in the operational functioning of this electronic system or in the computer equipment and devices of the Users, caused by reasons beyond I LOVE FERRY's control, that prevent or delay the provision of services or navigation through the System;

(ii)              Delays or blockages in use caused by deficiencies or overloads of the Internet or other electronic systems;

(iii)            That may be caused by third parties through unlawful interference beyond the control of Reservations and not attributable to I LOVE FERRY;

(iv)             Differences in information, documentation, and/or other content on the Website that may exist between the electronic version and the printed version;

(v)               The impossibility of providing the Service or allowing access due to reasons not attributable to I LOVE FERRY, due to the User, third parties, or force majeure.

3.3. I LOVE FERRY does not generally control the use that Users make of the Website. In particular, I LOVE FERRY does not guarantee under any circumstances that Users use the Website in accordance with the law, these General Terms, morality, and generally accepted good customs and public order, nor that they do so in a diligent and prudent manner.

3.4. Within the Website, links may be made to other websites over which I LOVE FERRY has no control and whose content it is not responsible for. Similarly, I LOVE FERRY will not be responsible for the technical availability of the web pages accessed by the user through its website.

The user assumes exclusive responsibility for any damages that may arise from access to such content, as well as for any other damage or harm caused to their computer system by any material downloaded or obtained in any other way through the use of services or for any loss of data resulting from downloading such material.

Similarly, I LOVE FERRY will not be responsible for damages arising from infringements by any user that affect the rights of other users, or third parties, including Copyright, trademarks, patents, confidential information, and any other intellectual and industrial property rights.

4. USER OBLIGATIONS

4.1. In general, the User is obliged to comply with these General Terms of Use, and where applicable the Specific Terms that may apply, as well as to comply with any special warnings or instructions contained therein or on the Website, and to always act in accordance with the law, good customs, and the requirements of good faith, using the appropriate diligence for the nature of the service enjoyed, refraining from using the Website in any way that may prevent, damage or deteriorate its normal operation, the goods or rights of I LOVE FERRY, its suppliers, the rest of the Users or, in general, any third party.

4.2. Specifically, and without implying any restriction to the general obligation assumed by the User in accordance with the previous section, the User undertakes, when using the Website and providing services to:

(i)                 In the case of registration, the User undertakes to provide truthful information and to keep it updated;

(ii)              The User undertakes not to introduce, store, or disseminate on or from the Website, any information or material that is defamatory, libellous, obscene, threatening, xenophobic, incites violence, or discrimination based on race, sex, ideology, religion or in any way violates morality, public order, fundamental rights, public liberties, honour, privacy or the image of third parties, and in general the applicable regulations;

(iii)            The User undertakes not to introduce, store, or disseminate through the Website any computer program, data, virus, code, hardware, or telecommunications equipment, or any other electronic or physical instrument or device that may cause damage to the Website, any of the Services, or any of I LOVE FERRY's equipment, systems, or networks, or those of any User, I LOVE FERRY's suppliers, or any third party, or that is otherwise capable of causing any type of alteration or preventing their normal operation;

(iv)             The User undertakes to adequately safeguard the "Username" and "Password" provided by I LOVE FERRY and/or its suppliers to the Users, as identifying and enabling elements for access to the various services offered on the Website, and undertakes not to transfer their use or allow access to them by third parties, assuming responsibility for any damages that may arise from improper use of them. Likewise, the user undertakes to notify I LOVE FERRY, as quickly as possible, of their loss or theft as well as any risk of access to the "Username" and/or "Password" by a third party;

(v)               The User undertakes not to engage in advertising, promotional, or commercial exploitation activities through the Website, and not to use the content and in particular the information obtained through the Website to send advertising, or send messages for direct sales purposes or for any other commercial purpose, or to collect or store personal data of third parties;

(vi)             The User undertakes not to use false identities or impersonate others in the use of the Website or the use of any of the services on the Website, including the use of third-party passwords or access keys or any other means;

(vii)          The User undertakes not to destroy, alter, use for their own use, disable or damage the data, information, programs, or electronic documents of I LOVE FERRY, and/or its suppliers or third parties;

(viii)        The User undertakes not to introduce, store or disseminate through the Website any content that infringes intellectual property rights, industrial property rights, and/or business secrets of third parties, or any content that they do not have the right to make available to third parties in accordance with the law.

Communications from I LOVE FERRY to the User will be made in accordance with the data provided by the User when registering on the Website.

The User expressly accepts, for all communications related to the use of the Website, and/or the contracting of the services offered therein, the use of email as a valid procedure for sending such communications.

5. APPLICABLE LAW. JURISDICTION.

5.1. These terms will be governed by Spanish law, which will be applicable in matters not provided for in this contract concerning interpretation, validity, and execution.
